1. General provisions

The online store operating at iseller.com.pl (hereinafter referred to as the "Store") is run by: Daryna Vodolazkina , NIP 5253074209 , REGON 543707822 , permanent place of business: ul. Żurawia 32/34, unit 29, 00-515 Warsaw, Poland (hereinafter referred to as the "Seller").

The Regulations define the rules for using the Store, in particular: placing orders, concluding distance selling contracts, payments, deliveries, personal collection, withdrawal from the contract, complaints and rules for the sale of used devices.

The Regulations are made available free of charge in the Store in a manner enabling their downloading, reproduction and recording.

Contracts are concluded in Polish. The Store may provide information in other languages; in the event of any discrepancies, the Polish version shall prevail.
2. Definitions

Customer – an entity placing an order in the Store.

Consumer – a natural person performing a legal act not directly related to his or her business or professional activity.

Entrepreneur with consumer rights – a natural person conducting business activity, concluding a contract directly related to the activity, when the content of the contract indicates that it is not of a professional nature for that person (Article 38a of the Consumer Rights Act).

Goods – a product offered in the Store, including new devices, used devices and accessories.

Contract – a sales contract concluded at a distance between the Customer and the Seller.

Working days – days from Monday to Friday, excluding public holidays.
3. Information about the Goods

Information about the Goods (description, price, availability) provided in the Store constitutes an invitation to conclude a Contract.

The features of the Goods, including important parameters, can be found in the product descriptions.
-
In the case of used Goods, the description includes information about the condition (e.g. A/B/C), possible traces of use and key features (e.g. battery condition, if applicable).

Photos of the Goods may be of an illustrative nature, unless it is clearly indicated that they show a specific item (usually applies to used devices).
4. Placing orders and concluding the Agreement

Orders can be placed 24/7 via the Store.

To place an order, the Customer:
-
selects the Product(s) and adds them to the basket,
-
chooses the delivery/pickup method,
-
chooses the payment method,
-
provides the data necessary to complete the order,
-
accepts the Regulations and places an order.

Placing an order by the Customer constitutes an offer to conclude a Contract.

The Agreement is concluded upon confirmation of acceptance of the order for execution by the Seller (e-mail).

The Seller may refuse to process an order in justified cases, in particular if the information provided is incorrect or if there is an obvious error in the price/description of the Goods. In such a case, the Seller will immediately inform the Customer and refund any payments received.
5. Prices and payments

Prices in the Store are given in PLN and are gross prices (including VAT), unless expressly stated otherwise.

Available payment methods are presented during the ordering process and may include online payments (e.g. Przelewy24), bank transfer (if available) and other methods available in the shopping cart.

In the case of payment by traditional transfer, order processing begins after the funds are credited to the Seller's account.

The Seller may provide discounts and promotions on the terms described in the Store.
6. Delivery and personal pickup

Delivery is carried out within Poland.

Available delivery/collection methods (as selected in the basket):

InPost (Parcel Locker/Courier) ,

Warszawa Express (iSeller's own courier) – in Warsaw,

Personal collection – ul. Żurawia 32/34, room 29, 00-515 Warsaw .

The shipping cost and any free shipping threshold are visible in the shopping cart before placing your order.

Delivery times are approximate and depend on, among other things, the chosen delivery method and the availability of the Goods.
7. Right of withdrawal from the Contract (returns)

The Consumer and the Entrepreneur with consumer rights have the right to withdraw from the Agreement within 14 days from the date of taking possession of the Goods.

To exercise the right of withdrawal, the Customer submits an unequivocal declaration (e.g. e-mail to info@iseller.com.pl ) and provide the order number.

The Customer is obliged to return the Goods no later than 14 days from the date of withdrawal.

The Seller will refund all payments received from the Customer, including delivery costs (except for additional costs resulting from the Customer choosing a delivery method other than the cheapest standard method offered in the Store), no later than 14 days from the date of receipt of the declaration of withdrawal.

The Seller may withhold reimbursement until the Goods are received back or proof of their return is provided, whichever occurs first.

The Customer is liable for any reduction in the value of the Goods resulting from their use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

The right of withdrawal does not apply in cases provided for by law, in particular in relation to goods in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons, if the packaging was opened after delivery (if it concerns the given Goods).
8. Complaints – non-conformity of the Goods with the Agreement

The Seller is liable to the Consumer and the Entrepreneur under consumer rights for non-conformity of the Goods with the Agreement under the principles arising from legal provisions.

Complaints can be submitted:

providing your order number and a description of the problem.

If possible, the Customer should attach photos/videos or other information to facilitate the processing of the complaint.

The Seller will respond to the complaint within 14 days .

If the complaint is accepted, the Seller will bring the Goods into compliance with the Agreement (repair or replacement), and if this is impossible or requires excessive costs, the Seller will reduce the price or refund the funds in accordance with the regulations.
9. Special rules for used devices

Used devices may have traces of use as described (e.g. condition A/B/C).

The description of the used device (condition, features, possible defects) is an important element of the Agreement.

The Seller may offer additional, voluntary iSeller protection/guarantee under the terms specified in the offer description or in the document provided to the Customer. Such protection does not exclude or limit the Customer's rights arising from the provisions regarding non-conformity of the Goods with the Agreement.
10. Additional services

The Seller may offer additional services (e.g. glass installation, configuration, data transfer), the scope and price of which are indicated in the Store or agreed individually.

In the case of services provided in-person, the Client may be asked to make an appointment.
11. Personal data

The administrator of personal data is the Seller indicated in point 1 of the Regulations.

Detailed rules for the processing of personal data are specified in the Privacy Policy available in the Store.
12. Extrajudicial methods of resolving disputes
-
The consumer may use out-of-court dispute resolution methods, in particular with the assistance of municipal/district consumer ombudsmen and the Trade Inspection.

Information on the possibility of using the ODR platform (EU) applies if the relevant provisions provide for such a solution.
13. Final provisions

The applicable law is Polish law.
-
In matters not regulated by the Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

The Seller may change the Terms and Conditions for important reasons (e.g., changes in regulations, payment methods, or delivery methods). Changes do not affect orders placed before the changes take effect.
